1. Agreement to Terms

By accessing or purchasing any course from ELDTOnlineTheory.com, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website or purchase any course.

These Terms constitute a legally binding agreement between you (“Student,” “you,” or “your”) and ELDTOnlineTheory.com LLC (“Company,” “we,” “us,” or “our”), a Missouri limited liability company.

2. Description of Services

ELDTOnlineTheory.com provides online theory training courses for commercial motor vehicle drivers as required under the Federal Entry-Level Driver Training (ELDT) regulations set forth in 49 CFR Part 380. We are a Registered Training Provider listed on the Federal Motor Carrier Safety Administration (FMCSA) Training Provider Registry (TPR).

Our courses satisfy the theory training requirements for the following CDL upgrades and endorsements:

  • Class A CDL
  • Class B CDL
  • Class B to Class A Upgrade
  • Passenger Endorsement
  • School Bus Endorsement
  • Hazardous Materials Endorsement

Completion of a theory course through ELDTOnlineTheory.com does not guarantee issuance of a CDL or endorsement. Licensing decisions are made solely by your state’s driver licensing authority.

3. Eligibility

To purchase and complete a course, you must:

  • Be at least 18 years of age (21 for certain interstate operations)
  • Possess or be in the process of obtaining a valid commercial learner’s permit (CLP) or CDL
  • Provide accurate personal information including your full legal name as it appears on your driver’s license, date of birth, driver’s license number, and issuing state
  • Have access to a device with a modern internet browser

You are responsible for ensuring you meet all eligibility requirements before purchasing a course.

4. Account Registration

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password
  • Not share your account credentials with any other person
  • Notify us immediately of any unauthorized use of your account

Each account is for a single individual student only. Sharing account access for the purpose of completing training on behalf of another person is strictly prohibited and may result in immediate account termination without refund.

5. FMCSA Data Reporting

By enrolling in any course, you expressly consent to the collection and reporting of your personal training data to the FMCSA Training Provider Registry as required by 49 CFR Part 380. This data includes your full legal name, date of birth, driver’s license number, issuing state, course completion date, and pass/fail status.

This reporting is a federal regulatory requirement. We are legally obligated to submit this information and cannot process exemptions or opt-outs.

6. Course Access and Completion

  • Course access is granted immediately upon successful payment processing
  • You must achieve a passing score of 80% or higher on the final assessment to receive a certificate of completion
  • There is no minimum time requirement to complete the course material
  • You may retake the final assessment if you do not achieve a passing score on your first attempt
  • Course access does not expire as long as your account remains in good standing

7. Payment and Pricing

All course fees are listed in United States dollars. Payment is due in full at the time of purchase. We accept major credit and debit cards through our secure payment processor.

Prices are subject to change at any time without notice. The price displayed at the time of your purchase is the price you will be charged.

8. No Refund Policy

All sales are final. We do not offer refunds under any circumstances.

Because our courses provide immediate digital access to training content upon purchase, and because FMCSA regulations require us to report enrollment data, we are unable to issue refunds once a purchase has been completed.

If you experience a technical issue that prevents you from accessing your course, please contact us and we will work to resolve the issue. Technical difficulties do not entitle you to a refund but we will ensure you receive the access you paid for.


9. Acceptable Use

You agree not to:

  • Use any automated means to access, scrape, or copy course content
  • Reproduce, distribute, or resell any course materials
  • Attempt to circumvent any technical measures protecting course content
  • Submit false or fraudulent information during registration or assessment
  • Allow any other person to complete assessments on your behalf
  • Use the platform for any unlawful purpose

Violation of these terms may result in immediate account termination and reporting to relevant authorities including the FMCSA.

10. Intellectual Property

All course content including text, videos, graphics, assessments, and materials are the exclusive property of ELDTOnlineTheory.com LLC and are protected by United States copyright law. You are granted a limited, non-transferable, non-exclusive license to access course content solely for your personal educational use.

You may not copy, reproduce, distribute, modify, or create derivative works from any course content without our express written permission.

11. Disclaimer of Warranties

Our courses and platform are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

We make no warranty that completion of our courses will result in the issuance of a CDL, endorsement, or employment. Licensing and hiring decisions are made solely by state licensing authorities and employers.

12. Limitation of Liability

To the fullest extent permitted by applicable law, ELDTOnlineTheory.com LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or related to your use of or inability to use our services.

Our total liability to you for any claim arising out of these Terms or your use of our services shall not exceed the amount you paid for the course giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless ELDTOnlineTheory.com LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms or your use of our services.

14. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

You and ELDTOnlineTheory.com LLC both waive the right to a jury trial and the right to participate in a class action lawsuit.

Arbitration shall take place in Missouri. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for violations of intellectual property rights.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ELDTOnlineTheory.com LLC regarding your use of our services and supersede all prior agreements and understandings.
